The following Terms and Conditions govern your access to and use of this website and the ordering of services
and the products from CD to Digital. Such Terms and Conditions constitute an agreement between CD to Digital
and you. By requesting services from CD to Digital, you acknowledge that you have read these Terms and Conditions carefully, and understand and agree to them.
1. We cannot convert
2. CDs that you have created, or CDs created by someone else and given to you, will be returned to you,
unprocessed.
3. The condition of CDs submitted will have an effect on the sound quality of the converted files. Every effort is
made to clean and repair damaged discs. Badly scratched or damaged CDs that are not repairable will be
returned to you, unprocessed.
4. CDs that cannot be converted for the reasons listed above will still be counted as part of the total number of
CDs processed, and you will be billed according to the prices posted on our website.
5. Shipments of CDs are insured for $12 per CD.
6. Your credit card will be charged when you place your order. The amount charged for CD conversion is based
on the number of CDs entered on the online order form. If the actual number of CDs processed differs from
the amount stated, you will be charged or refunded accordingly.
7. If we do not receive your CDs within 30 days of your order date, we will refund all but $25 charged to your
credit card. The $25 charge is for the cost of shipping and packaging materials sent to you.
8. CD to Digital reserves the right at any time to accept or decline the order for any reason.
9. CD to Digital will not be held (liable) responsible for:
• customer failing to follow shipping instructions
• copyright violations
• customer failing to provide accurate shipping address or other information requested
• shipping company’s terms and conditions
10. Occasionally, there are inaccuracies in the database used for tagging and album art. CD to Digital is not
responsible for inaccurate or incomplete data.
11. We are in the business of converting personally owned music CDs to digital format so that our
customers can enjoy their music collection on their computer, portable music player, or stereo system.
This service is only available for conversion of CDs you are authorized or legally permitted to change in
format. By asking us to convert your collection, you are representing to us that you personally own the
material, and that you will use the digital files created according to U.S. copyright laws. Such digital files
can be used, copied, shared or distributed only within the terms of "fair use" copyright laws. (See our
Legal page for a summary of the copyright laws.) You agree to hold CD to Digital harmless from any
violation of copyright laws by your use of the service.
12. CD to Digital will not be held (liable) responsible for any damages that you may incur by illegally
duplicating or distributing CD to Digital converted music files.
13. You must be at least eighteen (18) years of age to order our services. By placing an order with CD to Digital,
you hereby confirm that you are at least eighteen (18) years of age.
14. In the case of a claim concerning any damaged shipment or other shipping-related claim, you must
retain all original shipping containers, packaging and contents, and make the foregoing items
available for our inspection.
15. The right to damages against CD to Digital under any cause of action arising form or relating to the
provision of services or products or shipment of any products shall be waived unless such claim is
brought within three (3) months of delivery of a specific order.
16. CD to Digital services and products are provided "as is" without representation or warranty of any kind
except as expressly stated herein. Without limiting the foregoing, CD to Digital expressly disclaims all
implied warranties and warranties that the products or services provided are fit for a particular purpose.
CD to digital shall not be liable for any indirect, special, incidental, punitive or consequential damages
as a result of providing its products and services.
17. You agree to indemnity, defend and hold CD to Digital harmless from and against any and all claims,
damages, losses, costs and expenses that arise directly or indirectly from (a) your breach of any
provisions of these terms and conditions; (b) any allegation that any materials you provide constitute
infringing materials.
